24 July 2024 – Perth, Australia: Morgan Alteruthemeyer Legal Group confirms that on 24 July 2024 class action legal proceedings were commenced in the Supreme Court of Western Australia against three BGC Housing Group companies.
This is the first class action to be commenced in the Supreme Court of Western Australia. It has been commenced on behalf of thousands of homeowners who entered into home building contracts with BGC Housing Group companies between January 2019 and September 2022.
In the Class Action it is claimed that BGC Housing Group breached the Australian Consumer Law and their contractual obligations with individual BGC homeowners.
Morgan Alteruthemeyer Legal Group Building and Construction Partner, Spencer Lieberfreund said “We are pleased to announce the commencement of the class action against BGC Housing Group. We have undertaken a significant amount of work getting to this point and we are pleased to be able to support our clients in pursuing their claim”.
A representative plaintiff of the class action, Mr James Buck, said “I am happy that the class action has now commenced. BGC’s conduct to me and my family while we were building our home left us devastated both financially and emotionally”.
Jess Spithoven, co-founder of the Facebook BGC Proposed Class Action Group and class action member, speaking on behalf of the Group’s other co founders, Domenica Vecchio and Tanya Princi, said “The Court action has begun and we hope all those homeowners affected by BGC’s actions will receive their full compensation under the law”.
